1. TERMS OF SALE (TOURS AND TICKETS)

1.1 Scope of Services

Real's tour NYC offers guided experiences that may include:

Walking tours of neighborhoods and iconic locations in New York City;
Bus or van tours within NYC and surrounding areas;
Night tours and seasonal themed tours;
Ferry or public transportation segments;
Out-of-state excursions (e.g., Washington DC, Philadelphia, Boston, Amish Country);
Other services described in our tour descriptions.

Descriptions, inclusions, and approximate durations are indicated on the Site or in booking materials. These descriptions are indicative and may be modified for operational or safety reasons.

1.2 Tickets and Confirmation

When purchasing a ticket:

You will receive a confirmation by email or other proof of purchase with the contact information you provide.
Your ticket may be: An electronic ticket (e-ticket) sent by email or accessible through the booking system; and/or A physical ticket or wristband issued by our staff before the tour.

1.3 Ticket Validity

Unless otherwise indicated:

Tickets are only valid for the reserved date(s) and time(s).
They are not transferable and may not be resold, copied, or altered.
Your ticket does not guarantee a specific seat, vehicle, or exact route; all services are subject to availability and operational conditions.

We may:

Deny service to anyone presenting a fraudulent, altered, or resold ticket;
Cancel or modify tours when reasonably necessary for safety, weather, or operational reasons.

1.4 Tour Routes, Schedules, and Changes

We strive to operate tours as described; however:

Start and end times and routes are approximate and may be adjusted without prior notice;
We may modify, shorten, divert, or substitute stops or segments (including ferry, subway, or bus) due to: Traffic, street closures, protests, parades, or construction; Weather conditions; Safety reasons; Delays or problems with third-party transportation providers.

These changes do not automatically grant the right to a refund, except when the tour is completely canceled.

We allow minors on most tours; however, any participant under 18 years of age must be accompanied by a responsible adult throughout the tour.
The accompanying adult accepts full responsibility for the minor's conduct and safety.

We may deny participation to minors if they do not have adequate supervision.

1.6 Conduct During Tours

We reserve the right to remove a participant without refund if they:

Behave in a hostile, threatening, or abusive manner toward guides, staff, or other participants;

Ignore safety instructions;
Endanger their safety or that of others;
Interfere with the tour's operation.

2. CUSTOMER CONDUCT AND SAFETY

2.1 General Conduct

By booking and/or participating in a tour, you agree to:

Follow all reasonable instructions from Real's tour NYC staff and guides;
Behave respectfully toward all participants, staff, and the public;
Refrain from illegal, disruptive, or dangerous activities.

We may remove anyone we reasonably consider:

Offensive, disruptive, dangerous, or abusive; or
Capable of negatively affecting the safety, comfort, or experience of others.

No refund will be granted in these cases.

2.2 Safety Expectations

To maintain a safe environment, you agree to:

Exercise caution near traffic, curbs, crossings, stairs, bridges, and water areas;
Remain with the group unless authorized by the guide;
Follow instructions in crowded areas and near streets;
Wear appropriate footwear and clothing for walking and weather conditions;
Not climb, cross barriers, or enter restricted or unsafe areas.

You understand that tours may involve extended walking, public transportation, ferry crossings, and exposure to crowded or noisy environments.

3. MINORS AND FAMILIES

Every participant under 18 years of age must be accompanied by a parent, guardian, or authorized adult.
The responsible adult: Must remain near the minor at all times; Is responsible for the minor's behavior and compliance with these Terms; Accepts all risks and responsibilities associated with the minor's participation.

We may deny participation or ask an adult to remove the minor from the tour if we consider that safety or behavior standards are not met.

4. PHOTOGRAPHY AND MEDIA

4.1 Photography and Video by the Company

During tours, Real's tour NYC or its representatives may take photographs, audio recordings, or videos that include participants.

By participating, you:

Grant Real's tour NYC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and display such images or recordings for promotional, advertising, educational, or documentation purposes (including websites, social media, and printed materials);
Waive any right to inspect or approve the final material;
Waive any claim for compensation or royalties for such use.

If you do not wish to appear prominently:

You must inform the guide before the tour begins;
We will make reasonable efforts to respect your preference, although we cannot guarantee that you will not appear incidentally in group images or public spaces.

5. ACCESSIBILITY AND SPECIAL NEEDS

We strive to accommodate accessibility needs when reasonably possible; however, some tours:

Include extensive walking, stairs, uneven surfaces, and crowded areas;
May have limited access for wheelchairs, mobility devices, or strollers due to NYC infrastructure or venues operated by third parties.

If you need accommodations:

Contact us at least 48 hours before your tour;
Indicate your specific needs so we can assess feasibility.

We cannot guarantee full accessibility at all venues, although we will make reasonable efforts within practical and legal limitations.

6. LOST ITEMS

You are solely responsible for your personal belongings.

Real's tour NYC is not responsible for:

Lost, stolen, or damaged items;
Items left on buses, ferries, meeting points, or stops.

If we find an item, we may keep it for a limited period, but we have no obligation to maintain a formal lost and found system, nor do we assume responsibility for the loss or disposal of unclaimed items.

7. PRICES, PROMOTIONS, AND AGENTS

7.1 Prices

Tour prices are published on our Site or through authorized partners and generally include applicable taxes unless otherwise indicated.
We reserve the right to change prices before you complete a booking.

7.2 Discounts and Promotions

8. REFUNDS, CANCELLATIONS, AND WEATHER

8.1 Customer Cancellations and No-Shows

No-shows (not arriving on time at the designated location) are not refundable;
Late arrivals that result in missing the tour or part of the tour do not entitle you to a refund or rescheduling;
Some high-cost or out-of-state tours may have stricter policies due to transportation or third-party expenses.

8.2 Cancellations or Changes by the Company

If Real's tour NYC cancels a complete tour for reasons under our reasonable control:

You will be offered a refund or rescheduling, subject to availability.

If we shorten or modify a tour due to weather, safety, traffic, or similar conditions:

Such modifications do not automatically grant the right to a refund, especially if the main experience is reasonably maintained.

8.3 Weather Policy

Tours operate normally in rain or sunshine. You are responsible for dressing appropriately.

In cases of severe or dangerous weather (extreme storms, official alerts):

We may modify routes, shorten tours, delay starts, or cancel tours when necessary for safety.
If we completely cancel a tour due to dangerous weather, a refund or rescheduling will be offered.

9. ASSUMPTION OF RISK AND LIMITATION OF LIABILITY

9.1 Inherent Risks

By booking or participating in a Real's tour NYC tour, you understand and accept that:

Walking tours, public transportation, ferry segments, and bus/van travel involve inherent risks, including but not limited to: Trips, slips, or falls on uneven or slippery surfaces; Interaction with vehicular traffic, bicycles, scooters, and pedestrians; Crowded environments with the possibility of accidental contact; Stairs, bridges, and elevated or confined spaces; Exposure to weather (heat, cold, rain, snow, wind); Noise, air quality, and other typical urban conditions.

You voluntarily accept all these risks, known and unknown.

9.2 Health and Physical Condition

You confirm that:

You are in adequate physical and mental condition to participate in the chosen tour;
You will manage your own medical needs, medications, and hydration;
You will inform us, if you wish, of any condition that could affect your safety.

If you have doubts about your health or ability, you should consult a medical professional before booking.

9.3 Limitation of Liability

To the maximum extent permitted by law:

Real's tour NYC, its owners, employees, contractors, and affiliates will not be liable for: Indirect, incidental, special, punitive, or consequential damages; Loss of profits, business, or data; Loss or damage to personal property; Delays, inconveniences, or itinerary changes.
